Litter Free Upland – Liability & Participation Waiver

Activity: Community litter pickup and beautification (walking outdoors, lifting/carrying filled bags up to ~25 lbs, using hand tools like grabbers, and sorting/counting trash for weight totals).

Supervision: Volunteers are supervised by designated adult leads.

Who may agree to this waiver

Adults (18+): By checking “I agree,” you consent for yourself.

Minors (under 18): A parent or legal guardian must be the person who checks “I agree,” consenting for the minor.

Assumption of Risk & Safety

You understand that outdoor cleanups involve inherent risks, including but not limited to: slips/trips/falls; sharp objects or hazardous materials; sun/heat exposure; uneven terrain; insects/animals; and proximity to streets/parking areas.

- You (or your minor) agree to:

- Wear closed-toe shoes and weather-appropriate clothing.

- Use provided gloves and tools properly.

- Follow safety briefings, remain with the group, and comply with supervisor instructions.

- Avoid lifting items beyond personal capability and report hazards to a supervisor.

- Participate only if medically fit; consult a healthcare provider if unsure.

Waiver, Release, and Indemnification

To the fullest extent permitted by law, you (and, if applicable, on behalf of your minor):

1) Release and waive Litter Free Upland, Upland Acts of Service, and their officers, directors, employees, volunteers, sponsors, and partnering property owners/municipalities (“Released Parties”) from any and all claims for injury, illness, damage, or loss arising out of ordinary negligence connected with participation.

2) Assume all risks, known and unknown, associated with participation.

3) Indemnify and hold harmless the Released Parties from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from participation, except to the extent caused by the gross negligence or willful misconduct of a Released Party.

This waiver does not waive rights that cannot legally be waived.

Medical Treatment Authorization

If an emergency occurs and a parent/guardian (for minors) or emergency contact cannot be reached promptly, you authorize the Released Parties to obtain emergency medical treatment as deemed necessary. You accept responsibility for any related costs and agree to manage your (or your minor’s) routine personal medications (e.g., inhalers, EpiPens) and to inform a leader of their location as needed.

Transportation

You are responsible for transportation to/from events unless otherwise arranged in writing. Released Parties are not responsible for unattended minors before check-in or after check-out.

Photo/Video & Media

Litter Free Upland/Upland Acts of Service may photograph or record activities for program awareness, reports, and social media without compensation. If you do not consent, please contact a leader before the event starts and we can accommodate.

Code of Conduct

You (or your minor) agree to behave respectfully; avoid unsafe/unsanitary items (e.g., needles, chemicals) and alert a leader instead; refrain from horseplay; and comply with all applicable laws and event rules. Violations may result in removal from the activity.

Term & Records

By checking “I agree,” you acknowledge that this waiver applies to all Litter Free Upland activities for 365 days from the date of acceptance, unless revoked in writing. Keep your confirmation email (if provided) for your records.
